IN NO EVENT SHALL PIZZA LUCE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE WEBSITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
The limitations of liability set forth above are fundamental elements of the basis of the bargain between Pizza Luce and you. Some states do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Pizza Luce, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. The arbitrator shall have the authority to award any remedy available at law or equity, except that the arbitrator shall have no authority to award punitive damages, and each party waives any right to seek or recover punitive damages. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
12.3 Class Action Waiver
YOU AND PIZZA LUCE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Pizza Luce agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.
12.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to prevent irreparable harm. This exception does not waive the requirement to arbitrate other disputes.
